Times You May Need to File an FR-19 in Maryland

If you own a vehicle in Maryland, you must maintain active car insurance as proof of financial responsibility. Financial responsibility ensures that when an accident or damage happens, you can cover all injury or property damage costs. While most drivers are aware of the general need for car insurance, certain situations require filing an FR-19 (Financial Responsibility) form.

Understanding When to Submit an FR-19 Form in Maryland

Failure to Maintain Car Insurance

One of the primary reasons for filing an FR-19 form is if you fail to maintain adequate car insurance coverage. If your car insurance lapses or you don’t carry the minimum coverage required by Maryland law, the state may require you to file an FR-19.

The state will typically notify you that your vehicle registration is suspended. You will need to file this form to reinstate it. This form serves as proof that you now have proper car insurance coverage. It shows that you comply with the state’s financial responsibility laws.

Accident Without Insurance

If you’re involved in a car accident in Maryland and you don’t have car insurance at the time of the incident, you’ll be required to file an FR-19 form. This filing proves that you’re now meeting the state’s financial responsibility requirements after an uninsured accident.

If you don’t file the FR-19 and provide proof of insurance, your driving privileges may be suspended. The MVA could also revoke your vehicle registration.

Uninsured Motorist Involvement

If you’re involved in an accident where the other party is uninsured or underinsured in Maryland, you may be required to file an FR-19 form. This is often the case if you’re at-fault. The form demonstrates that you have adequate coverage to meet the state’s financial responsibility standards.

Driving After a License Suspension

If your driver’s license was suspended because of an earlier violation, you may need to file an FR-19 form to reinstate it. This requirement typically applies to drivers who have had their license suspended for failure to maintain insurance. Once the FR-19 form is filed, it serves as proof that you now carry the required insurance. It often allows you to have your driving privileges reinstated.

Reinstating Registration After Suspension

If your vehicle’s registration was suspended for not having proper insurance, you’ll need to file an FR-19. The form must be filed with the MVA along with evidence of valid car insurance. Until this is complete, they won’t reinstate your vehicle’s registration.

Court-Ordered Requirement

In some cases, the court may order you to file an FR-19 form as part of a legal judgment. This can happen if you’re involved in an accident, have a history of traffic violations, or have been caught driving without insurance. The form acts as a court-mandated step to prove your compliance with Maryland’s car insurance laws.

Buying a New or Used Car

When you purchase a new or used car in Maryland, you’ll need to register it with the MVA. If you had a previous insurance lapse or suspension, the state may require you to submit an FR-19 form before allowing registration.

This form proves you now have the proper insurance coverage for your new vehicle. Without it, you might face delays in getting your tags and legally driving your car.

Switching Insurance Providers

Maryland’s MVA may ask for an FR-19 form if you change your car insurance company. Especially if there was a gap between policies. Even a short lapse in coverage could trigger this requirement.

Filing the FR-19 confirms that your new policy meets state minimums. This helps avoid registration suspensions or fines for appearing uninsured.

After Paying an Uninsured Driver Fee

In Maryland, some drivers who don’t have insurance pay an annual “uninsured motorist fee” to keep their registration active. However, if you later decide to get proper insurance, you’ll need to file an FR-19 form.

This cancels your uninsured status and proves you now have real coverage. Without submitting the form, the MVA might still treat you as uninsured and you risk getting penalties.

Leased or Financed Vehicles

Your lender may require full coverage insurance if your car is leased or financed. If they report a lapse to the MVA, the state could suspend your registration until you prove renewed coverage with an FR-19. Banks and leasing companies often monitor insurance closely, so filing this form quickly helps avoid extra fees or legal trouble.
